IN NO EVENT SHALL OUR AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF OUR SERVICES EXCEED THE GREATER OF (A) THE TOTAL AMOUNT PAID BY YOU TO SEASONS PIZZA IN THE SIX (6) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00).

The limitations set forth in this section shall apply regardless of the form of action, whether in contract, tort, strict liability, or otherwise, and shall survive the termination or expiration of these Terms. Some jurisdictions do not allow the exclusion or limitation of certain liabilities, so some of the above limitations may not apply to you. In such cases, our liability will be limited to the maximum extent permitted by applicable law.

8. Indemnification

You agree to indemnify, defend, and hold harmless Seasons Pizza and its officers, directors, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:

11.2 Binding Arbitration

If informal resolution is unsuccessful, any dispute, claim, or controversy arising out of or relating to these Terms, your use of our services, or any aspect of the relationship between you and Seasons Pizza shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules, rather than in a court of law, except as provided below.

The arbitration shall be conducted in English, and the arbitrator's decision shall be final and binding. The arbitrator shall have the authority to award any remedy available in a court of law, subject to the limitations set forth in these Terms. The costs of arbitration shall be borne in accordance with the AAA's Consumer Arbitration Rules.

11.3 Class Action Waiver

YOU AND SEASONS PIZZA EACH AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. IF FOR ANY REASON A CLAIM PROCEEDS IN COURT RATHER THAN IN ARBITRATION, YOU AND SEASONS PIZZA EACH WAIVE ANY RIGHT TO A JURY TRIAL.

11.4 Exceptions

Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights or confidential information. Claims for small claims court matters may also be brought in the appropriate small claims court.

If the class action waiver in Section 11.3 is found to be unenforceable, then the entirety of the arbitration agreement in this Section 11 shall be null and void.

12. Term and Termination

These Terms of Service shall remain in full force and effect for as long as you continue to access or use our Site or services. We reserve the right, in our sole and absolute discretion, to terminate or suspend your access to our Site and services, with or without cause, and with or without notice, effective immediately.
